Terms of Service

These Terms govern NearSoul, provided by Himalaya Industries. By selecting the agreement checkbox and continuing, you enter this agreement electronically and agree to the Community Guidelines and Child Safety Standards. We record the account, policy version, document fingerprint, server time and confirmation method. This is an electronic acknowledgement, not identity certification or a guarantee of enforceability in every situation.
2. Adults and account security
You must be at least 18, have capacity to enter a contract, and supply accurate information. Minors, impersonation and false age claims are prohibited. Keep credentials private and report compromised access. We may request reasonable verification or restrict an account where safety concerns arise. Verification badges or checks do not guarantee a person's identity, intentions or conduct.
3. Your conduct and content
You are responsible for your content and interactions. Obtain permission before sharing another person's images or information. Do not harass, stalk, threaten, defraud, exploit, distribute unlawful or sexually explicit material, infringe intellectual property, evade blocks, scrape personal data, attack the service or manipulate payments. Child sexual abuse and exploitation, including grooming and child sexual abuse material, are strictly prohibited.
4. Content rights
You retain your rights to content you provide. You grant NearSoul a non-exclusive, royalty-free license to host, store, reproduce, adapt for technical delivery and display it only to operate the service, deliver your sharing choices, provide moderation and meet legal obligations. The license ends when content is deleted from our systems, except for lawfully retained copies and copies already shared with others. You must have the rights needed to grant this license. NearSoul branding and software remain the rights of their respective owners.
5. Purchases
Review the checkout price, taxes, duration, allowances and renewal terms before paying. Access depends on verified payment and the purchased plan. Some products are fixed-term; recurring subscriptions renew only as described at checkout. Use Refund & Cancellation for the store cancellation and refund process. Deleting the app or your account does not itself cancel a store subscription. Nothing here removes mandatory consumer remedies.
6. Safety and offline meetings
NearSoul facilitates user connections and does not guarantee compatibility, identity, background checks, availability or safe offline meetings. Exercise care, meet in public, protect financial details and respect consent. Location and disappearing content features cannot prevent screenshots, redistribution or inference. NearSoul is not an emergency service. Contact local emergency services for immediate danger.
7. Moderation, suspension and appeals
We may review or remove content, restrict features, suspend or terminate accounts, preserve relevant evidence and report suspected offences when required by law. Decisions may use automated checks and human review. Urgent safety action can occur without advance notice. You can challenge a decision through Report a Problem or the Grievance Officer with your user ID and the decision details. Paid membership does not exempt anyone from safety rules.
8. Responsibility and limits
To the extent permitted by applicable law, the service is provided subject to availability, and we do not warrant uninterrupted or error-free operation. To that extent, we are not responsible for losses caused solely by other users or third parties, or indirect losses not reasonably foreseeable. These limits do not exclude our own liability where exclusion is prohibited, fraud, wilful misconduct, statutory consumer or data-protection rights, or any liability that cannot lawfully be limited. Users remain responsible for losses their unlawful conduct causes to the extent determined under applicable law.
9. Ending use and resolving concerns
You may stop using NearSoul and request account deletion at any time. Report concerns to support@nearsoul.in or the Grievance Officer. Indian law governs these Terms, subject to mandatory rights and competent courts or statutory forums available to you. You are not required to waive a lawful complaint, regulatory remedy or consumer claim.
10. Changes
We identify revisions by version and date and ask for renewed acceptance of material account-policy changes. If you do not accept, you can sign out and request your data or account deletion through support. If a provision is unenforceable, the remaining provisions apply to the extent lawful.
